TERMS & CONDITIONS

DRY HIRE TERMS & CONDITIONS

1.1. Upon approval signature or email reply by the client to the quote provided by Artisan Productions Ltd, the rental agreement is formed.

1.2. The client agrees to abide by the terms and conditions outlined herein upon confirmation of the rental booking.

DEFINITIONS

2.1. “Artisan Productions Ltd” refers to the equipment rental company providing services under these terms and conditions.

2.2. “Client” refers to the individual or entity renting equipment from Artisan Productions Ltd.

2.3. “Equipment” refers to the audiovisual, lighting, staging, and any other equipment rented by the Client from Artisan Productions Ltd.

2.4. “Rental Period” refers to the duration for which the Equipment is rented by the Client.

RENTAL PERIOD

3.1. The Rental Period begins from the time the Equipment is delivered to the Client or collected by the Client from Artisan Productions Ltd’s premises and ends upon the return of the Equipment.

3.2. Any extension of the Rental Period must be agreed upon in writing by both parties.

EQUIPMENT CONDITION

4.1. The Client acknowledges that the Equipment is rented in good working condition and agrees to inspect the Equipment upon delivery or collection.

4.2. The Client agrees to return the Equipment in the same condition as received, ordinary wear and tear excepted.

USE OF EQUIPMENT

5.1. The Client agrees to use the Equipment solely for its intended purpose and in accordance with any manufacturer instructions or guidelines provided by Artisan Productions Ltd.

5.2. The Client shall not modify, alter, or tamper with the Equipment in any way without prior written consent from Artisan Productions Ltd.

RENTAL CHARGES

6.1. The Client agrees to pay the rental charges specified by Artisan Productions Ltd for the Equipment, as well as any applicable taxes and fees.

6.2. Rental charges are based on the Rental Period and any additional services requested by the Client.

PAYMENT TERMS

7.1. Payment for Equipment rental charges is due upon confirmation of the rental booking.

7.2. Artisan Productions Ltd reserves the right to require a security deposit from the Client, which will be refunded upon return of the Equipment in satisfactory condition.

DELIVERY AND COLLECTION

8.1. Artisan Productions Ltd will arrange for the delivery and collection of the Equipment to and from the Client’s specified location.

8.2. The Client agrees to provide clear and safe access for delivery and collection of the Equipment.

LIABILITY AND INSURANCE

9.1. The Client assumes all risk of loss, theft, or damage to the Equipment during the Rental Period.

9.2. The Client agrees to maintain adequate insurance coverage for the Equipment during the Rental Period, naming Artisan Productions Ltd as an additional insured party.

9.3. The hirer must provide proof of insurance, prior to any collection/delivery of equipment.

9.4. The hirer must provide two forms of ID (one being valid photo ID, another being proof of address current within 3 months of hiring date) upon collection / receipt of equipment.

INDEMNIFICATION

10.1. The Client agrees to indemnify and hold Artisan Productions Ltd harmless from any claims, damages, losses, or expenses arising from the Client’s use or misuse of the Equipment.

TERMINATION

11.1. Artisan Productions Ltd reserves the right to terminate the Rental Agreement and reclaim the Equipment at any time if the Client breaches any provision of these terms and conditions.

GOVERNING LAW

12.1. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales, and any disputes arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

ENTIRE AGREEMENT

13.1. These terms and conditions constitute the entire agreement between Artisan Productions Ltd and the Client with respect to the rental of Equipment and supersede all prior agreements and understandings, whether written or oral.

EVENT PRODUTION TERMS & CONDITIONS

DEFINITIONS

1.1. In these terms and conditions, the following definitions apply:

– “Client” refers to the individual or entity engaging the services of Artisan Productions Ltd for event production.
– “Production Team” refers to Artisan Productions Ltd and its representatives providing event production services.

BOOKING

2.1. Upon approval, confirmed by signature or email reply from the client in response to the provided quote by the production team, a contract shall be established, binding both parties to these terms and conditions.

2.2. The terms and conditions outlined herein are binding upon approval of the quote.

2.3. Any modifications to the quote must be agreed upon by both the Client and Production Team before confirmation.

PAYMENT OF FEES

3.1. A deposit payment of 25% is required to confirm the booking. The remaining 75% balance is due 7 days prior to the event date.

3.2. Confirmed bookings exceeding £25,000 require an additional 25% deposit to secure the booking.

3.3. Deposit payments are non-refundable.

LATE / FAILURE PAYMENT OF PRODUCTION FEE

4.1. Late payments will incur a 5% interest charge on the total outstanding balance per week overdue.

4.2. Late payments will also incur a £50 administration fee payable by the Client within 14 days.

4.3. Failure to make full payment within 14 days may result in the debt being passed to a Debt Recovery Firm.

CANCELLATION

5.1. Termination of the Contract is permitted only in the case of ‘Force Majeure’ (Clause 12) or by mutual agreement between the Client and Production Team.

5.2. Cancellation fees apply as outlined in Clause 6.1, except in cases of ‘Force Majeure’.

CLIENT CANCELLATION

6.1. Cancellation fees apply if the Client terminates the contract for reasons other than ‘Force Majeure’.

6.2. Cancellation fees are detailed as follows:
– More than 365 days before event: Nil (excluding any incurred costs)
– Between 365-180 days before event: 40% of Full Fee
– Between 180-91 days before event: 60% of Full Fee
– Between 90-31 days before event: 80% of Full Fee
– 30 days or less before event: Full Fee

COMPLAINTS

7.1. Any complaints must be made in writing within 30 days. Full payment must still be made unless otherwise agreed.

7.2. Disputes regarding changes to the quote or service must be resolved directly between the Client and Production Team.

RESPONSIBILITIES OF THE CLIENT

8.1. The Client must ensure the venue meets specified requirements including power supply, performance area, and safe passage for equipment.

8.2. Free parking and any applicable charges must be arranged by the Client.

8.3. The Client must provide refreshments and a secure crew room for the Production Team.

PRODUCTION EQUIPMENT

9.1. Equipment provided by the Production Team is for exclusive use during the event.

9.2. Any damage to equipment caused by the Client’s party will be the Client’s responsibility.

9.3. All electrical equipment provided by the Production Team is PAT tested annually.

EXPENSES

10.1. Additional expenses agreed upon must be paid by the Client.

CHANGES TO THE AGREED TIMING SCHEDULE

11.1. Changes to the schedule must be mutually agreed upon in advance.

11.2. Any changes resulting in extended service hours will incur additional fees.

FORCE MAJEURE

12.1. Force Majeure applies to circumstances beyond the control of either party.

12.2. Cancellation fees will apply in cases of Force Majeure.

PHOTOGRAPHY AND VIDEOGRAPHY

13.1. The Client may opt out of having event photographs or videos used for promotional purposes.

JURISDICTION

14.1. Disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
